of Hire
1. Introduction - Welcome to Gather & Graze (G&G) . These Terms and Conditions outline the rules and regulations for the use of our venue space. By booking and using our venue, you agree to comply with and be bound by the following terms.
2. Booking and Payment -
2.1. All bookings must be made in advance and are subject to availability.
2.2. A refundable security deposit of $500 ($800 for 18th/21st celebrations) is required to secure the booking. The remaining invoice balance must be paid 10 working days before the event, with all numbers and dietaries confirmed at this time.
2.3. Payment methods accepted include EFT, Cash, Mastercard +1/7%, VISA + 1.7%, AMEX + 2%.
2.4. Any additional charges incurred during the event must be settled before departure with a credit card or cash payment.
3. Cancellations and Refunds -
3.1. Cancellations made 20 days before the event will be eligible for a 50% security deposit refund.
3.2. Cancellations made less than 10 days before the event forfeit their deposit.
3.3. G&G reserves the right to cancel bookings due to unforeseen circumstances, with a full refund provided.
4. Venue Use and Restrictions -
4.1. The venue is to be used only for the agreed-upon purpose.
4.2. The client is responsible for ensuring that all guests comply with venue rules.
4.3. No smoking or illegal activities are allowed on the premises. In the event emergency services are required to attend, due to patron behaviour, fees invoiced, are payable by the hirer.
4.4. Decorations and equipment must not damage the venue’s property and are to be removed by the hirer at the end of their event and disposed of by the hirer. Any damage caused by decorations or installations comes out of the hirers security deposit. If cost to repair falls above security deposit value, hirer will be invoiced at cost to fix/replace/repair and payment due at time of issue. Any contractor decorations can be removed the following morning by appointment.
4.5. Noise levels must be kept within acceptable limits, as per local regulations.
5. Liability and Indemnity -
5.1. G&G is not liable for any loss, damage, or injury incurred during the event.
5.2. The client is responsible for any damages caused to the venue or its property during the event.
5.3. Venue does not allow or provide insurance for any high-risk activities.
6. Health and Safety -
6.1. Clients must comply with all health and safety regulations.
6.2. The maximum venue capacity must not be exceeded.
6.3. FOODstyling reserves the right to stop an event if safety regulations are violated.
7. NDIS Provider Services -
7.1. If the venue is used for NDIS-related activities, clients must comply with all relevant regulations and guidelines.
7.2. Any specialized equipment or support required must be arranged in advance. Any equipment to be insured by the organsiation and/or hirer.
8. Termination of Use -
8.1. G&G reserves the right to terminate the event immediately if there is a breach of these terms.
8.2. No refunds will be issued if termination occurs due to a violation of these conditions.
9. Governing Law -
These terms and conditions are governed by the laws of City of Kingston and Victoria Police and emergency services, and any disputes shall be resolved within this jurisdiction.
